Welcome to DailyRentalStay.com (“DRS,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the DRS website, mobile applications, and related services (collectively, the “Platform”).

By accessing or using DailyRentalStay, you agree to these Terms. If you do not agree, you may not use the Platform.


Overview

DailyRentalStay provides an online marketplace connecting property owners and managers (“Hosts”) with guests seeking short-term accommodations (“Guests”).

DailyRentalStay is not a property owner, manager, real estate broker, or insurer. We facilitate bookings and payments but do not own, operate, or control any properties listed on the Platform.


Eligibility

You must:

  1. Be at least 18 years old (or the legal age of majority in your jurisdiction).
  2. Have the legal authority to enter into a binding contract.
  3. Use the Platform in compliance with applicable laws and these Terms.


Account Registration

To access certain features (e.g., listing a property, making a booking), you must create an account.

You agree to:

  1. Provide accurate, current, and complete information.
  2. Maintain and promptly update your account details.
  3. Keep your password confidential.
  4. Accept responsibility for all activities under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or our Trust & Safety Policy.


Platform Use

You may use DRS only for lawful purposes. You agree not to:

  1. Misrepresent your identity or property details.
  2. Use the Platform to commit fraud, harassment, or discrimination.
  3. Circumvent service fees or conduct off-platform bookings.
  4. Upload malicious code, spam, or unauthorized advertising.
  5. Violate intellectual property, privacy, or data protection laws.

Violations may result in suspension, termination, or legal action.


Bookings & Payments

A. Guest Responsibilities

  1. You agree to pay all booking amounts, taxes, and fees at the time of reservation.
  2. You must comply with the Host’s house rules and local laws during your stay.
  3. You are responsible for any damages or violations during your reservation.

B. Host Responsibilities

  1. You must provide accurate property details and maintain required safety standards (see Trust & Safety Policy).
  2. You agree to honor confirmed bookings and maintain clear cancellation policies.
  3. Hosts are responsible for complying with local regulations, permits, and taxes.

C. Platform Role

DailyRentalStay facilitates payments via secure third-party processors.

All financial transactions occur through the Platform. Off-platform payments are prohibited.


Fees

DRS may charge service fees to Hosts and Guests for use of the Platform.

Fees are clearly disclosed before booking confirmation.

All fees are non-refundable unless otherwise required by law or stated in DRS policies.


Cancellations & Refunds

Cancellations and refunds are governed by each Host’s listing policy and applicable DRS procedures.

If a Host cancels a booking, Guests may receive a full refund.

If a Guest cancels, applicable fees or penalties may apply.

Refund processing times vary depending on payment provider and region.


Damage Claims & Security Deposits

If a Host reports damage caused by a Guest, DRS may facilitate resolution, charge the Guest’s payment method, or deduct from a security deposit.

Both parties must provide supporting documentation (photos, receipts, estimates).

Fraudulent claims are prohibited and may lead to account termination.


Content & Reviews

Users may post reviews, photos, or other content (“User Content”).

You grant DRS a worldwide, royalty-free, sublicensable license to use, display, and distribute User Content for Platform operation and promotion.

You represent that your content:

  1. Is truthful and non-defamatory.
  2. Does not infringe third-party rights.
  3. Complies with DRS’s Trust & Safety Policy and Content Guidelines.

We may remove content violating our rules or applicable laws.


Privacy & Data Protection

Your privacy matters to us. Our Privacy Policy explains how we collect, use, and protect your information.

By using the Platform, you consent to our data practices as described in that policy.


Intellectual Property

All trademarks, logos, designs, software, and content on DailyRentalStay belong to DRS or its licensors.

You may not copy, distribute, modify, or exploit any part of the Platform without written consent.


Disclaimer of Warranties

DailyRentalStay provides the Platform “as is” and “as available.”

We do not guarantee that listings, services, or features will be error-free, uninterrupted, or meet your expectations.

DRS makes no warranties about the quality, safety, legality, or accuracy of listings or user conduct.


Limitation of Liability

To the fullest extent permitted by law:

  1. DRS shall not be liable for any indirect, incidental, consequential, or punitive damages.
  2. Our total aggregate liability shall not exceed the amount you paid to DRS for your booking within the past 12 months.

Some jurisdictions do not allow limitations on liability; in such cases, the limitation may not apply.


Indemnification

You agree to defend, indemnify, and hold harmless DRS, its affiliates, and employees from claims, damages, or expenses arising from:

  1. Your use of the Platform;
  2. Violation of these Terms or applicable law;
  3. Infringement of any third-party rights.


Termination

We may suspend or terminate your account or access to the Platform at any time for:

  1. Policy violations;
  2. Fraud or misuse;
  3. Legal or regulatory requirements.

You may stop using the Platform at any time by closing your account.


Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Georgia, USA (or applicable jurisdiction where DRS is registered).

Any dispute shall be resolved through binding arbitration or small claims court, unless prohibited by law.

Users may not pursue class or collective actions against DRS.


Modifications

We may update these Terms from time to time.

The latest version will always be available on our website with an updated “10/16/2025.”

Continued use of the Platform after updates constitutes acceptance of the new Terms.
